Allgemeine Geschäftsbedingungen (AGB)
Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge über Online-Coaching und Online-Training, die zwischen dem Einzelunternehmen Thomas von der Heyden, Hohenzollernallee 14, 40235 Düsseldorf, und dem Kunden abgeschlossen werden. Mit der Buchung eines Termins erklärt sich der Kunde mit diesen AGB einverstanden.
Die angebotenen Leistungen umfassen Online-Coaching für Führungskräfte sowie Online-Trainings, die individuell oder in Gruppen durchgeführt werden. Die Leistungen werden nach vorheriger Absprache online über Plattformen wie Zoom, Teams oder Google Meet erbracht.
Ein Vertrag kommt zustande, sobald der Kunde das Angebot annimmt, sei es durch eine schriftliche Bestätigung (per E-Mail) oder durch die Buchung eines Termins über das Online-Terminbuchungssystem.
4.1. Termine können ausschließlich über das bereitgestellte Online-Terminbuchungssystem vereinbart werden.
4.2. Eine Stornierung ist bis spätestens 24 Stunden vor dem vereinbarten Termin kostenfrei möglich. Erfolgt die Stornierung später oder erscheint der Kunde nicht zum Termin, wird das vereinbarte Honorar in voller Höhe berechnet.
4.3. Eine Terminänderung kann, je nach Verfügbarkeit, individuell abgestimmt werden.
5.1. Einzelaufträge sind im Voraus per PayPal zu begleichen. Die Zahlung muss spätestens vor Beginn der vereinbarten Leistung vollständig eingegangen sein.
5.2. Für Gruppen-Trainings oder langfristige Coaching-Vereinbarungen können individuelle Zahlungsmodalitäten vereinbart werden.
5.3. Alle Preise verstehen sich netto zuzüglich der gesetzlich geltenden Umsatzsteuer, sofern anwendbar.
6.1. Der Anbieter haftet nicht für die Ergebnisse des Coachings oder Trainings, da diese wesentlich von der aktiven Mitarbeit des Kunden abhängen.
6.2. Für technische Störungen oder Ausfälle der verwendeten Online-Plattformen übernimmt der Anbieter keine Haftung.
Die Verarbeitung personenbezogener Daten erfolgt gemäß der Datenschutz-Grundverordnung (DSGVO). Details hierzu finden sich in der Datenschutzerklärung auf unserer Website.
8.1. Als Verbraucher steht dem Kunden ein Widerrufsrecht gemäß § 355 BGB zu, sofern der Vertrag nicht mit einer Leistungserbringung innerhalb der Widerrufsfrist beginnt und der Kunde dies ausdrücklich wünscht.
8.2. Details zum Widerrufsrecht werden dem Kunden vor Vertragsabschluss zur Verfügung gestellt.
Der Anbieter verpflichtet sich, alle im Rahmen der Zusammenarbeit erhaltenen Informationen streng vertraulich zu behandeln und nicht an Dritte weiterzugeben.
10.1. Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
10.2. Gerichtsstand ist der Sitz des Einzelunternehmens.

Términos y Condiciones Generales (TCG)
Estos Términos y Condiciones Generales (TCG) se aplican a todos los contratos de coaching en línea y formación en línea que se celebren entre el empresario individual Thomas von der Heyden, Hohenzollernallee 14, 40235 Düsseldorf, y el cliente. Al reservar una cita, el cliente acepta estos TCG.
Los servicios ofrecidos incluyen coaching en línea para líderes y formaciones en línea, que se realizan de manera individual o en grupo. Los servicios se proporcionan mediante plataformas en línea como Zoom, Teams o Google Meet, previa consulta.
El contrato se considera celebrado una vez que el cliente acepte la oferta, ya sea mediante confirmación escrita (por correo electrónico) o mediante la reserva de una cita a través del sistema de reservas en línea.
4.1. Las citas solo pueden reservarse a través del sistema de reservas en línea proporcionado.
4.2. La cancelación es gratuita si se realiza como máximo 24 horas antes de la cita acordada. Si la cancelación se realiza más tarde o si el cliente no asiste a la cita, se cobrará el honorario completo.
4.3. Un cambio de cita puede coordinarse individualmente, dependiendo de la disponibilidad.
5.1. Los servicios individuales deben pagarse por adelantado a través de PayPal. El pago debe haberse recibido en su totalidad antes del inicio del servicio acordado.
5.2. Para formaciones grupales o acuerdos de coaching a largo plazo, se pueden acordar condiciones de pago específicas.
5.3. Todos los precios se entienden netos, más el IVA legal aplicable, si corresponde.
6.1. El proveedor no es responsable de los resultados del coaching o la formación, ya que estos dependen fundamentalmente de la participación activa del cliente.
6.2. El proveedor no se hace responsable de interrupciones técnicas o fallos en las plataformas en línea utilizadas.
El tratamiento de los datos personales se lleva a cabo de acuerdo con el Reglamento General de Protección de Datos (RGPD). Los detalles al respecto se encuentran en la declaración de privacidad en nuestro sitio web.
8.1. Como consumidor, el cliente tiene derecho a desistir del contrato de acuerdo con el § 355 BGB, siempre que la prestación del servicio no comience dentro del período de desistimiento y el cliente lo haya solicitado expresamente.
8.2. Los detalles sobre el derecho de desistimiento se proporcionarán al cliente antes de la celebración del contrato.
El proveedor se compromete a tratar toda la información recibida en el marco de la colaboración de forma estrictamente confidencial y a no divulgarla a terceros.
10.1. Si alguna disposición de estos TCG es o se vuelve inválida, la validez de las disposiciones restantes no se verá afectada.
10.2. El lugar de jurisdicción será la sede del empresario individual.

General Terms and Conditions (GTC)
These General Terms and Conditions (GTC) apply to all online leadership coaching and online training contracts concluded between the sole proprietor [Your Name], Hohenzollernallee 14, 40235 Düsseldorf, and the client. By booking an appointment, the client agrees to these GTC.
The services offered include online coaching for leaders and online training, provided individually or in groups. Services are delivered via online platforms such as Zoom, Teams, or Google Meet, as agreed upon in advance.
The contract is considered concluded once the client accepts the offer, either through written confirmation (via email) or by booking an appointment through the online booking system.
4.1. Appointments can only be booked through the provided online booking system.
4.2. Cancellation is free of charge if made at least 24 hours before the agreed appointment. If cancellation occurs later or the client does not attend, the full fee will be charged.
4.3. Appointment rescheduling can be arranged individually, depending on availability.
5.1. Individual services must be paid for in advance via PayPal. Full payment must be received before the start of the agreed service.
5.2. For group training or long-term coaching agreements, specific payment terms can be arranged.
5.3. All prices are stated net, plus applicable VAT, if required.
6.1. The provider is not responsible for the results of coaching or training, as these fundamentally depend on the client’s active participation.
6.2. The provider is not liable for technical interruptions or failures of the online platforms used.
The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR). Details on this can be found in the privacy policy on our website.
8.1. As a consumer, the client has the right to withdraw from the contract in accordance with § 355 BGB, provided the service does not begin within the withdrawal period and the client has expressly requested it.
8.2. Details of the right of withdrawal will be provided to the client before the conclusion of the contract.
The provider commits to treating all information received in the context of collaboration with strict confidentiality and not disclosing it to third parties.
10.1. If any provision of these GTC is or becomes invalid, the validity of the remaining provisions will not be affected.
10.2. The place of jurisdiction will be the location of the sole proprietor’s registered office.
